Understanding Injury Law in NY

Have you suffered illness or injury due to another person or party’s negligence? It is understandable that you may feel unsure of whether or not to pursue a personal injury case. Remember that Brooklyn and Bronx personal injury laws exist for a reason—so that there is a method for you to protect yourself in the case of personal injury, and to seek the compensation to which you are entitled.

Types of personal injury

Numerous types of personal injury exist. However, under personal injury law in Brooklyn and the Bronx, there is a single constant factor in determining personal injury: negligence. If your personal injury was caused by an act of negligence by another person or party, you should consult a Bronx and Brooklyn injury law professional to assess your case.

There are four main categories under which most personal injuries fall, and under which it is possible to assign negligence:

  • Automobile accidents. In car, truck, motorcycle, or other motor vehicle accidents, it is possible to suffer personal injury when another driver acts inattentively or negligently. Dangerous behaviors on the road include disregarding the speed limit or other safety laws, becoming distracted with a cellular phone or other electronic device, driving while fatigued, or driving under the influence of drugs or alcohol.
  • Medical malpractice. Malpractice makes up a significant portion of personal injury law in Bronx and Brooklyn. Medical malpractice cases can be the most difficult for victims and their loved ones, because their trust in a medical professional has been betrayed. A health care provider may commit negligence by misdiagnosing a condition or failing to diagnose at all, making surgical errors, administering or prescribing improper doses of medications or anesthesia, or failing to monitor the health and recovery of a patient.
  • Product liability. If you were injured or harmed by a consumer product, you may be entitled to compensation under Brooklyn and Bronx injury law. The manufacturer, creator, or distributor of the product may have acted negligently if the product was improperly manufactured, poorly designed, or sold without sufficient warning of its risks.
  • Premises liability. If you were injured at a public location that was insufficiently maintained or did not include necessary signage to warn of dangers, you may have grounds for a lawsuit under Bronx and Brooklyn personal injury law. In these cases, the property owner is typically held responsible for any injuries that occur on the premises.
